Acceptable Use Policy

1. Purpose and Scope
This Acceptable Use Policy (the "Policy") sets out the rules that apply to all use of the Aopy platform and related services (the "Service"), operated by Easy Life Tech SRL ("Aopy", "we", "us"). This Policy forms an integral part of our Terms of Service; a violation of this Policy is a breach of the Terms. Capitalised terms not defined here have the meaning given to them in the Terms of Service.
This Policy applies to the Customer and to every person who accesses the Service under a Customer's account, including team members and agents. The Customer is responsible for ensuring that everyone who sends messages through its account complies with this Policy.
2. Anti-Spam Rules
The Service may be used only for permission-based marketing. The following rules are mandatory for every email and SMS campaign sent through the Service:
- Consent first. Marketing emails and SMS may be sent only to recipients who have validly consented to receive them, in accordance with applicable law (including the GDPR and, for electronic marketing communications in Romania, Law no. 506/2004).
- Proof of consent on request. You must keep records showing when, how and for what each recipient consented, and you must provide that proof to us promptly upon our request. Inability to demonstrate consent may lead to enforcement measures under Section 5.
- No purchased or harvested lists. You must not send to purchased, rented, borrowed, scraped or otherwise harvested address lists, to e-appended data, or to any list whose provenance you cannot demonstrate. Practical guidance is available in our Data Processing Guidelines.
- Working unsubscribe, always. Every marketing email sent through the Service includes an automatically inserted, per-send unsubscribe link. You must not remove, hide, obscure or disable it, and you must honour every opt-out promptly and permanently. SMS recipients can opt out by replying STOP or DEZABONARE, which the Service honours automatically — see our SMS Compliance page.
- Truthful sender identity. Sender names, from-addresses, subject lines and message content must accurately identify you and must not be false, deceptive or misleading. Impersonating another person, brand or organisation is prohibited.
3. Prohibited Content
You must not use the Service to create, store, send or distribute content that:
- is illegal under applicable law, or promotes or facilitates illegal activity;
- is deceptive or fraudulent, including phishing, sender spoofing, pyramid or "get-rich-quick" schemes, or the impersonation of any person, brand or organisation;
- contains or links to malware, viruses, spyware or any other harmful code;
- infringes the intellectual-property rights or other proprietary rights of any third party;
- constitutes hate speech, harassment, threats, or incitement to violence or discrimination;
- contains sexual content involving minors, or exploits or endangers minors in any way — we apply zero tolerance and will report such content to the competent authorities;
- promotes high-risk regulated products or services (for example gambling, financial services or medicinal products) without the authorisations required by applicable law.
This list is illustrative, not exhaustive. We may treat other content of comparable gravity as a violation of this Policy.
4. Prohibited Conduct
When using the Service you must not:
- probe, scan or test the vulnerability of the Service, or breach or attempt to breach any security or authentication measure;
- circumvent or attempt to circumvent rate limits, sending quotas or any other technical restriction of the Service;
- access, or attempt to access, another customer's data or any area of the Service you are not authorised to use;
- resell, sublicense or otherwise make the Service available to third parties without a separate written agreement with us;
- interfere with or disrupt the integrity or performance of the Service, its infrastructure, or other customers' use of the Service;
- use the Service to support, outside the Service, any of the practices prohibited by Sections 2 and 3 (for example, hosting phishing pages reached through links sent via the Service).
5. Deliverability and Enforcement
Sending reputation is a shared resource: abusive sending from one account damages deliverability for every customer. We therefore monitor aggregate sending signals, including bounce and complaint rates, on an ongoing basis.
We deliberately do not publish fixed numeric thresholds. Sending behaviour is assessed qualitatively and in context — abnormally high bounce or complaint rates, evidence of non-consensual sending, or content violations may each trigger enforcement.
Enforcement is normally graduated:
- Warning — we contact you and describe the problem;
- Throttling — we may slow down or limit sending from your account;
- Suspension — we may suspend sending or access to the account;
- Termination — for persistent or serious violations, in accordance with the Terms of Service.
For severe abuse — including illegal content, phishing, attacks against the Service, or conduct that poses an immediate risk to other customers or to deliverability — we may suspend the account immediately, without prior warning. As part of any enforcement review we may request proof of consent under Section 2.
6. Reporting Abuse
If you believe the Service has been used to send spam or abusive content — for example, you received an unsolicited message sent through our platform — please report it to support@aopy.com. Where possible, include the full message (with technical headers) and any other relevant details. We review all abuse reports and take appropriate action under this Policy.
7. Changes to This Policy
We may update this Policy from time to time, for example to address new abuse patterns or new legal requirements. Material changes will be announced by email or by a prominent notice in the platform, in accordance with the Terms of Service. Continued use of the Service after a change takes effect constitutes acceptance of the updated Policy.
8. Language
This Policy is available in English and Romanian. In the event of any discrepancy or dispute over interpretation between the two versions, the English version prevails.
